One American-owned company, Adriatic Kayak Tours, based in Dubrovnik, has been using our photographs on their website and in their brochures without permission. We have asked them to stop, but they persist. Our lawyer has said it is slow to deal with such issues in Croatia. Does anyone have any experience with copyright infringement?

All the photos, except the one at the bottom and the one in the middle top, on their page - adriatickayaktours.com/tours-vis.html - are mine.

The 4 bottom pictures on - adriatickayaktours.com/tours-pedalpaddle.html - were provided to me by Felix Oppenheim, a professional Swedish photographer, with the his permission that I was to use them on my advertising (credited of course) as I saw fit (I have his original email from 2 years ago).

The two lower right pictures on - adriatickayaktours.com/index.html - are copies of those used on other pages.

Thanks to all for the messages on how to solve this problem. Adriatic Kayak Tours in Croatia has now removed our photographs from their website. The method used to force them to comply was the Digital Millenium Copyright Act - their ISP, Google and Yahoo all threatened to shutdown their website if they didn't take our pics off.

I've just had a local rafting company steal one of my photos. I mailed them more than 48 hours ago asking them to kindly remove the photo and explained to them about the Digital Millennium Copyright Act AS WELL AS the Copyright Act 98 of 1978 in terms of South African law which covers any South African work to any other country too. So far, zero reply. I've just mailed Yahoo, I am going to fax Google just now as they don't accept e-mails but how would I contact their internet service provider? How do you know who runs them, if I can call it that? Any advice would be most grateful. Thanks.

If they had just asked, I would have gladly sent them some pictures free of charge. But now the end result is more than likely that their site will be dropped from search engine results and of course that is bad for their business.. People are so short sighted. But then again it's a typical South African mentality where people don't give a rats ass about any kinds of laws. It can be seen from simple things like people driving double the speed limit, to more serious things like rape and murder. South Africa has one of the highest crime rates in the world. A lot of it stems from people having zero regard for our so called 'law'. Then when they are caught, their punishments don't fit the crime and so the entire system is ridiculed. Anyway, enough of me carrying on... Just a little agitated today.. hehehe :dry: Must be the fact that it is rainy nicely and I can't paddle! :woohoo: :huh:

go to a 'whois' such as - www.networksolutions.com/en_US/whois/index.jhtml
put in their url - in our case we were searching for adriatickayaktours.com
then something like this will appear -
