A defense attorney says he will ask a federal judge to review a state Supreme Court ruling allowing prosecutors to seek the death penalty in the retrial of a man charged in the murder of a woman in central Pennsylvania more than a decade ago.Forty-three-year-old Paul Aaron Ross is charged in the murder of 26-year-old Tina Miller, whose body was found partially submerged and bound with duct tape at Canoe Creek State Park in June 2004.Ross was convicted in the murder but won a retrial in 2011 after an appeals court said his attorney hadn't had enough time to fully prepare a defense and testimony by three of his ex-girlfriends was inappropriate.The (Altoona) Mirror reports that a Blair County judge scheduled a retrial for June.
